Terms of Service

1. Acceptance and scope
These Terms of Service (the "Terms") are provided by Synux Operator ("we," "us," or "our") and apply when you access or use the Synux website, dashboard, OpenAI-compatible API, model routing, credit purchases, and related services (collectively, the "Service"). By creating an account, purchasing credits, calling the API, or continuing to use the Service, you acknowledge that you have read, understood, and agreed to these Terms and the Privacy Policy.
You must be at least 18 years old and able to enter into a binding contract. If you use the Service on behalf of a company or another organization, you confirm that you have authority to bind that organization to these Terms. Do not use the Service if you do not agree to these Terms.
2. Service description
Synux is a digital AI infrastructure service delivered over the internet. It provides a unified API, model catalog, intelligent routing, usage metering, and credit management to help users access capabilities from third-party model providers such as OpenAI, Anthropic, Google, and DeepSeek. The models, capabilities, context limits, and unit prices available at any time are shown in the dashboard model and pricing catalog and in the interface before a purchase or call.
After a successful purchase, credits are generally added to your account as soon as Synux confirms Waffo Pancake's signed payment notification. A payment return page or browser redirect alone does not mean that a top-up is complete. The account balance and transaction status displayed in the dashboard are the final record.
3. Accounts and security
- Accounts currently use GitHub for sign-in. You must provide accurate information and keep your sign-in email available.
- You must protect sign-in sessions and API keys and must not publish, resell, or share them with unauthorized third parties.
- Calls, usage, and activity under your account are generally treated as authorized by you. If you notice unusual activity, revoke the affected API key and contact us immediately.
- If you use the Service for an organization, you must ensure that its members, developers, and end users comply with these Terms.
4. Credits, pricing, and usage
4.1 One-time purchases
Synux currently uses a prepaid-credit model. Each top-up is a separate, one-time purchase, not a subscription. It does not renew automatically or trigger automatic charges to replenish credits. If we offer subscriptions or automatic top-ups in the future, we will separately display the amount, billing period, and cancellation method and obtain your explicit authorization before enabling them.
4.2 Quotes and deductions
Before a top-up, we display the currency, amount charged, and estimated credits received. Model calls deduct credits according to the published model, input, output, or other metered units in effect when the call occurs. We may change future model prices but will not retroactively change completed calls. Credits are not bank deposits or electronic money, do not earn interest, and cannot be transferred or redeemed for cash.
4.3 Expiration
Unless clearly stated before purchase, purchased credits have no fixed expiration date while your account remains active. Promotional, bonus, or gifted credits may have separate eligibility rules, usage priority, and expiration dates, which will be described when they are issued.
5. Payments, taxes, and billing disputes
Waffo Pancake acts as Merchant of Record and legal seller and provides checkout, payment collection, tax calculation, receipts, refunds, and dispute handling. You authorize Waffo Pancake to make the one-time charge shown on the checkout page. Applicable VAT, sales tax, GST, or other taxes are calculated and displayed at checkout based on legal requirements and billing information.
Waffo Pancake processes complete card numbers and security codes; Synux does not store them. Your card statement may show Waffo Pancake, Pancake, or another descriptor identified on the checkout page or receipt. Keep your payment receipt. If you have a question about a charge, contact us using the details at the end of this page so that we can review the transaction before you initiate a bank chargeback.
6. Refund policy
Digital credits can be used immediately after they are added to your account. You may request a refund in the following situations:
- First-purchase guarantee: You may request a full refund within seven days of your first purchase if none of the credits from that purchase have been used.
- Duplicate or incorrect charge: A verified duplicate charge, incorrect amount, or successful charge that was not credited may be fully refunded or corrected.
- Extended service outage: If the core Service is unavailable for more than 72 consecutive hours for reasons within our control, we may provide a prorated refund or equivalent credits based on the actual impact.
- Statutory rights: Any non-waivable withdrawal, refund, or consumer-protection rights in your jurisdiction remain in effect.
Credits that have been used, transferred, or frozen because of a violation of these Terms are generally non-refundable unless the law requires otherwise. A refund request must include the account email address, Waffo transaction or receipt number, purchase date, and reason, and must be sent to team@synux.ai. We generally acknowledge a request within two business days. Eligible refunds are usually returned to the original payment method within 5–10 business days after approval, although actual timing depends on Waffo Pancake, the card issuer, and the payment network.
7. Acceptable use
You may use the Service only lawfully and safely. You must not use it to engage in or assist with:
- Creating or distributing unlawful, fraudulent, defamatory, harassing, hateful, or rights-infringing content;
- Creating content that sexually exploits minors, or deceptive deepfakes that impersonate real people;
- Developing malware, phishing, credential theft, unauthorized intrusion, sabotage, or methods to bypass security controls;
- Infringing intellectual property, privacy, publicity, trade-secret, or other legal rights;
- Evading rate, billing, or model limits, bulk-scraping or reselling the Service, or interfering with the platform or other users; or
- Presenting unverified model output as medical, legal, financial, or other licensed professional advice.
We may investigate suspected fraud, abuse, sanctions risk, card-network violations, or unlawful conduct and may limit calls, freeze affected features, or terminate an account when necessary.
8. Input, output, and intellectual property
You retain any rights you lawfully hold in content you submit ("Input") and grant us a limited license to use it only as needed to route and process requests, provide Output, bill for usage, protect the Service, and provide support. We do not use Input or Output to train Synux-owned models without your explicit consent.
You may use generated results ("Output") to the extent allowed by applicable law and the terms of the selected model provider. Providers may apply different rules to Input, Output, commercial use, and retention. Before using a model, review the relevant rules and confirm that your Input and Output do not infringe third-party rights.
AI Output may be inaccurate, incomplete, biased, or outdated. You must review it before relying on or publishing it and must not use it directly as the basis for high-risk, professional, or rights-affecting decisions.
9. Service changes and availability
Model capabilities depend on third-party providers, networks, and infrastructure and may be rate-limited, retired, repriced, or temporarily interrupted. We work to maintain a reliable Service but do not guarantee that any model, response time, or feature will remain available permanently. When necessary, we may replace routes, limit high-risk requests, or discontinue a feature and will provide advance notice of material changes when reasonably practical.
10. Data and privacy
The Privacy Policy explains how we collect, use, share, and retain personal information and how model requests flow to selected providers. Waffo Pancake processes payment-card data, which does not enter Synux servers.
11. Suspension, termination, and account deletion
You may stop using the Service and submit an account-deletion request from the Account page in the dashboard. Deletion requires manual verification and does not take effect immediately after you click. Once deletion takes effect, API keys, account access, and remaining credits can no longer be used. If you need a refund, submit the request under Section 6 before deletion is completed.
We may suspend or terminate the Service if you materially violate these Terms, create a fraud or security risk, fail to pay an amount due, or if the law, Waffo Pancake, a card network, or a model provider requires us to act. Where legally permitted and consistent with risk management, we will explain the reason. Transaction, tax, security, and dispute records that must be retained by law are not deleted immediately when an account is closed.
12. Disclaimers and limitation of liability
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we make no express or implied warranty about the accuracy of model Output, fitness for a particular purpose, uninterrupted availability, or third-party services. We are not responsible for indirect, incidental, special, or punitive damages or for lost profits, data, or goodwill.
To the maximum extent permitted by law, our total direct liability arising from the Service will not exceed the amount you actually paid us during the 12 months before the event giving rise to the dispute. This limit does not apply to liability that cannot lawfully be excluded or limited, including liability for willful misconduct and non-waivable consumer rights.
13. Changes to these Terms
We may update these Terms to reflect product, billing, legal, or security changes. We generally provide at least 14 days' notice of material changes through your registered email address, a dashboard notice, or a website announcement, and update the date at the top of this page. Continuing to use the Service after a change takes effect means that you accept the revised Terms. If you do not agree, stop using the Service and resolve any remaining credits before the effective date.
14. Governing law and disputes
These Terms are governed by the laws of the jurisdiction where the operator is established, without affecting any non-waivable consumer-protection rules where you live. If a dispute arises, both parties should first attempt to resolve it in good faith using the contact information below. If it cannot be resolved, either party may bring the dispute before a court or consumer-dispute body with lawful jurisdiction.
